Terms of Service

These Terms of Service (the "Terms") are a legal agreement between you and Shane Burton, developer of Real Claw ("Real Claw," "we," "us," or "our") governing your access to and use of Real Claw websites, web applications, live claw machines, account features, camera streams, profiles, leaderboards, and related services (collectively, the "Service").

Our Privacy Policy explains how we collect, use, share, and protect information and is incorporated into these Terms by reference.

Please read these Terms carefully. By accessing or using the Service, you agree to these Terms. If you do not agree, do not access or use the Service.

1. Eligibility

You must be at least 13 years old to use the Service.

If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Parents and guardians are responsible for supervising a minor's use of the Service.

You may not use the Service if applicable law prohibits you from doing so or if Real Claw has previously suspended or terminated your access for violating these Terms.

2. What Real Claw Provides

Real Claw is an online entertainment service that allows users to watch and remotely control real physical claw machines over the internet. Depending on availability and the features offered at the time, the Service may include:

• Guest play;
• User accounts and authentication;
• Gameplay queues and timed turns;
• Live machine camera feeds and selectable camera angles;
• Player profiles, avatars, and voluntarily submitted social links;
• Gameplay results, statistics, achievements, and leaderboards;
• Advertising and optional ways to support Real Claw; and
• Community features such as chat, comments, shared gameplay, or gameplay clips.

Some features may be experimental, unavailable, changed, delayed, interrupted, or discontinued at any time. References in these Terms to a feature do not guarantee that the feature is currently available or will be offered in the future.

3. Free Play and No Physical Prizes

Real Claw is currently offered as a free entertainment experience. No purchase or donation is required to watch, enter a queue, or play an available machine.

Gameplay results, including a detected "win," are for entertainment, statistics, achievements, leaderboards, and bragging rights only. Real Claw does not currently award, ship, deliver, redeem, or exchange physical prizes, cash, merchandise, virtual currency, or anything else of monetary value based on gameplay. Items visible inside a machine remain the property of Real Claw or the machine operator unless Real Claw expressly states otherwise in separate written rules.

Real Claw may change its business model or introduce additional features in the future. Any paid feature, promotion, contest, sweepstakes, or physical-prize program would be governed by additional disclosures or rules presented before participation. Nothing in these Terms creates a right to any future feature or prize.

You remain responsible for charges imposed by your internet, mobile, or other service provider in connection with your use of the Service.

4. Guest Play and Accounts

You may be able to watch or play without creating an account. Guest play may rely on browser storage or session identifiers to operate queues, turns, preferences, security, and abuse prevention.

Some features may require an account. Account registration may be available through email and password or a supported third-party sign-in provider, such as Google or Apple. Your use of a third-party sign-in provider is also subject to that provider's terms and privacy practices.

When creating or using an account, you agree to:

• Provide accurate information;
• Keep your login credentials secure;
• Use only accounts you are authorized to use;
• Promptly notify us if you believe your account has been accessed without permission; and
• Accept responsibility for activity conducted through your account, except to the extent caused by Real Claw's own failure to use reasonable security measures.

You may not create accounts to evade a suspension, bypass queue limits, manipulate statistics, impersonate another person, or gain an unfair advantage. We may limit the number of accounts associated with one person, household, device, network, or verified identity when reasonably necessary to prevent abuse.

Display names, avatars, social links, and other public profile information must comply with these Terms.

5. Queues, Turns, and Gameplay

Machine access is limited and may be managed through queues, reservations, cooldowns, time limits, and other fairness controls. Queue position and estimated wait times are approximate and are not guaranteed.

You agree to follow all on-screen gameplay instructions and reasonable rules announced through the Service. You may not:

• Use bots, scripts, automation, macros, emulators, modified clients, or similar tools to play or enter a queue;
• Open or coordinate duplicate sessions to obtain multiple queue positions;
• Interfere with another player's turn;
• Attempt to bypass timers, cooldowns, safety controls, authentication, or access restrictions;
• Send commands outside the controls and methods provided by the Service;
• Exploit bugs, latency, stream behavior, or technical errors for an unfair advantage;
• Attempt to access, damage, reconfigure, or disable a physical machine or its supporting systems; or
• Use the Service in any unlawful, deceptive, abusive, or disruptive manner.

Real Claw may remove abandoned queue positions, reject duplicate entries, end or skip a turn, clear a queue, pause a machine, activate an emergency stop, or take other reasonable steps to protect users, equipment, fairness, and Service reliability.

Gameplay depends on internet connections, cameras, encoders, browsers, cloud services, machine hardware, sensors, and control systems. Video latency, command latency, dropped frames, delayed input, stream interruptions, or sensor errors may occur. A visible result, machine response, or "win" message may be delayed, inaccurate, or unavailable. Real Claw may correct or remove gameplay results and statistics that are affected by a malfunction, abuse, or obvious error.

6. Acceptable Conduct

You may not use the Service to:

• Violate any law or another person's rights;
• Harass, threaten, stalk, shame, or abuse another person;
• Post hateful, sexually explicit, violent, exploitative, defamatory, deceptive, or otherwise inappropriate content;
• Share another person's private or personal information without authorization;
• Impersonate another person or falsely suggest an affiliation with Real Claw;
• Upload malware or attempt to probe, scan, disrupt, overload, reverse engineer, or gain unauthorized access to the Service;
• Collect user information through scraping, automated means, or other unauthorized methods;
• Manipulate leaderboards, wins, viewer counts, accounts, queues, or gameplay records;
• Advertise, solicit, spam, or promote unrelated commercial activity without permission; or
• Encourage or assist anyone else in violating these Terms.

We may investigate suspected misuse and may preserve or disclose relevant information when permitted or required by law and as described in the Privacy Policy.

7. Profiles, Social Links, and Community Content

The Service may allow you to submit or display content such as a username, profile text, avatar, social link, message, comment, gameplay clip, reaction, or other material ("User Content").

You retain any ownership rights you have in your User Content. By submitting User Content, you give Real Claw a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, format, transmit, and distribute that content only as reasonably necessary to operate, promote, secure, and improve the Service. This license ends when the content is deleted from active systems, except for reasonable backup retention, legal obligations, content already shared outside our control, and uses that do not identify you.

You represent that you own or have all rights needed to submit your User Content and that its use through the Service will not violate any law, intellectual-property right, privacy right, publicity right, contractual obligation, or these Terms.

Public profile information and community content may be visible to anyone. Social links lead to third-party services that Real Claw does not control. Do not publish sensitive information that you do not want others to see.

We may review, moderate, hide, remove, or restrict User Content or community features when we reasonably believe it violates these Terms, creates risk, or interferes with the Service. We are not obligated to monitor all User Content and do not endorse content submitted by users.

8. Live Video, Recordings, and Gameplay Clips

Real Claw uses cameras to show physical machines and their immediate surroundings for gameplay, operation, security, troubleshooting, and related purposes. Live feeds may be viewable by multiple visitors and may be distributed through third-party video, hosting, or network providers.

If recording or clip features are introduced, the Service may capture, store, process, display, or share portions of machine video associated with gameplay. Additional notice or controls may be provided when appropriate. Users may not attempt to use machine feeds to surveil people, identify private information, or capture areas outside the intended machine view.

Optional Player Cam recordings require express consent. When enabled, the Service may create a picture-in-picture Reaction Replay for the player to preview. The Player Cam version is not saved or shared unless the player approves it; a separate machine-only replay remains available.

Unless Real Claw expressly provides a download or sharing feature, you may not rebroadcast, commercially exploit, scrape, archive, or redistribute machine feeds or clips without written permission.

9. Advertising and Optional Support

Real Claw may display advertising to help support the free Service. The appearance of an advertisement or third-party link does not mean that Real Claw endorses the advertiser, product, service, or linked content. Your dealings with advertisers and third parties are solely between you and them.

Real Claw may offer an optional donation or support feature. Donations are voluntary, are never required to play, and do not provide queue priority, additional turns, better odds, prizes, or any gameplay advantage. Unless expressly stated otherwise, donations are not tax-deductible and are non-refundable except where required by law. A third-party payment provider may process donations under its own terms and privacy policy. See our Donation and Refund Notice for additional details.

10. Intellectual Property

The Service, including the Real Claw name, logos, branding, site design, software, interfaces, text, graphics, audiovisual material, and other content supplied by Real Claw, is owned by or licensed to Real Claw and is protected by applicable intellectual-property laws.

Subject to these Terms, Real Claw grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, noncommercial entertainment. No other rights are granted.

You may not copy, modify, sell, license, distribute, publicly display, create derivative works from, or commercially exploit Real Claw content or technology except as expressly allowed by the Service or with our written permission.

If you believe content on the Service infringes your copyright or other intellectual-property rights, contact us at realclawapp@gmail.com with enough information for us to understand and evaluate your claim.

11. Third-Party Services

The Service relies on or may link to third-party services, including authentication, database, hosting, camera streaming, content delivery, analytics, advertising, social media, and payment providers. Examples may include Google, Apple, and Firebase.

Third-party services are governed by their own terms and privacy policies. Real Claw does not control and is not responsible for third-party services, their availability, security, content, or practices. Your use of those services is at your own risk and may require separate agreement with the applicable provider.

12. Service Availability and Changes

Real Claw may maintain, repair, update, test, suspend, limit, or discontinue any part of the Service at any time. Machines may be offline because of maintenance, operator availability, internet or power outages, equipment problems, safety concerns, suspected abuse, or other reasons.

We do not guarantee that the Service, a machine, a camera, a queue position, an account feature, or any specific content will always be available, uninterrupted, secure, accurate, or error-free. We may change turn lengths, queue rules, cooldowns, machine configurations, features, or eligibility requirements to maintain fair and reliable operation.

13. Suspension and Termination

You may stop using the Service at any time. You may request account deletion as described in the Privacy Policy.

Real Claw may warn, restrict, suspend, or terminate your account or access if we reasonably believe that you:

• Violated these Terms or another applicable policy;
• Created a safety, security, legal, or operational risk;
• Abused a machine, queue, account, community feature, or another user;
• Attempted fraud, cheating, unauthorized access, or manipulation; or
• Used the Service in a way that could expose Real Claw or others to harm or liability.

When practical, we may provide notice or an opportunity to correct a violation, but we are not required to do so when immediate action is reasonably necessary. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, indemnification, and dispute terms—will survive.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." Real Claw disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and security.

Real Claw does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free;
• Video or controls will have any particular latency or quality;
• A command will be received, performed, or displayed exactly as intended;
• Machine hardware, cameras, sensors, statistics, or win detection will always be accurate;
• Defects will be corrected; or
• User Content or third-party services will be accurate, safe, or available.

Your use of the Service is at your own risk. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, Real Claw and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, profits, opportunities, or use, arising from or related to the Service or these Terms, even if advised that such damages are possible.

To the fullest extent permitted by law, the total aggregate liability of Real Claw and the parties listed above for all claims arising from or related to the Service or these Terms will not exceed the greater of: (a) the amount you paid directly to Real Claw for use of the Service during the 12 months before the event giving rise to the claim; or (b) US $100.

These limitations apply regardless of the form of action and do not limit liability that cannot legally be excluded or limited.

16. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Real Claw and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from: (a) your violation of these Terms; (b) your misuse of the Service; (c) your User Content; or (d) your violation of another person's rights or applicable law.

This section does not require you to indemnify any party for its own unlawful conduct or to the extent indemnification is prohibited by applicable law.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except to the extent that applicable law in your place of residence requires otherwise.

Before filing a claim, you and Real Claw agree to make a reasonable, good-faith effort to resolve the dispute informally. You may begin that process by emailing realclawapp@gmail.com with a description of the issue and the relief requested.

Unless applicable law requires otherwise, any legal action arising from or related to the Service or these Terms must be brought in a state or federal court located in Delaware, and you and Real Claw consent to the jurisdiction of those courts.

Nothing in this section prevents either party from seeking appropriate relief in small-claims court or urgent injunctive relief where legally available.

18. Changes to These Terms

We may update these Terms as Real Claw develops, features or business practices change, or legal requirements change. When we update the Terms, we will revise the "Last Updated" date at the top of this page.

If a change is material, we may provide additional notice through the Service or by another appropriate method. Unless otherwise stated, updated Terms become effective when posted. Your continued use of the Service after updated Terms take effect means that you accept them, to the extent permitted by law.

19. General Terms

Entire Agreement. These Terms, the Privacy Policy, and any additional rules or policies presented for a particular feature constitute the entire agreement between you and Real Claw concerning the Service and replace prior agreements concerning the same subject.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted by law.

No Waiver. A delay or failure by Real Claw to enforce a provision is not a waiver of that provision or any other right.

Assignment. You may not assign or transfer these Terms without Real Claw's written consent. Real Claw may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or by operation of law.
